Who we are
Using our website
You may use our site for lawful purposes only. You agree not to:
- use the site in any way that breaches applicable law or regulation;
- attempt to gain unauthorised access to the site, its servers or any connected system;
- introduce viruses, trojans, worms or other malicious material;
- scrape, data-mine or systematically extract content from the site without our written permission;
- reproduce, resell or exploit any part of the site for commercial purposes without our written permission;
- impersonate any person, or misrepresent your affiliation with any person or organisation.
We may suspend or withdraw access to the site, or refuse to deal with you, if we reasonably believe you have breached these Terms.
Accounts
You may need an account to place an order. You are responsible for keeping your login details confidential and for all activity under your account. Tell us immediately at support@brimholm.store if you think someone else has accessed it. You must provide accurate, current information, and you must be at least 18 years old to create an account.
Products
We take care to describe and picture our products accurately, but:
- images are for illustration and the actual product may vary slightly;
- colours may appear differently depending on your screen;
- packaging may vary from that shown;
- dimensions and weights are approximate unless stated otherwise.
All products are subject to availability. We may change or discontinue products at any time without notice.
Prices and payment
Prices are shown in pounds sterling (GBP) and, unless stated otherwise, include UK VAT where applicable. Delivery charges are shown separately at checkout before you pay.
We take care to price products correctly, but errors happen. If we discover a pricing error after you place an order, we will contact you before dispatch and you may either confirm the order at the correct price or cancel it for a full refund. We will not charge you the higher price without your agreement.
We accept the payment methods shown at checkout. Payment is taken when you place your order. If your payment is declined or reversed, we may cancel your order.
How a contract is formed
- You place an order by completing checkout. This is an offer to buy, not an acceptance.
- We send an order acknowledgement email. This confirms we received your order — it is not acceptance.
- A binding contract is formed only when we send you a dispatch confirmation email.
We may refuse an order — for example because the item is out of stock, we identified a pricing or description error, we could not authorise payment, or we suspect fraud. If we refuse your order we will tell you and refund any payment in full.
Delivery
Delivery terms, timescales and costs are set out in our Shipping Policy, which forms part of these Terms.
Delivery estimates are estimates, not guarantees. Risk in the goods passes to you when they are delivered to the address you gave us. Ownership passes when we have received payment in full.
If nobody is available to receive the delivery, the carrier will follow its own process (leaving a card, attempting redelivery, or returning the parcel to us). If a parcel is returned to us because it was unclaimed or the address was wrong, we may charge you the cost of redelivery.
Returns, cancellation and refunds
Your right to cancel, return goods and receive a refund is set out in our Returns & Refunds Policy, which forms part of these Terms and does not affect your statutory rights.
Your legal rights as a consumer
If you buy as a consumer, the Consumer Rights Act 2015 gives you rights that these Terms cannot take away. In summary, goods must be of satisfactory quality, fit for purpose and as described. For detailed advice, contact Citizens Advice at citizensadvice.org.uk or on 0808 223 1133.
Intellectual property
All content on www.brimholm.store/ — text, graphics, logos, images, product photography, page layout, and software — is owned by us or our licensors and is protected by copyright, trade mark and other intellectual property laws.
You may view, download and print content for your own personal, non-commercial use. You may not otherwise copy, modify, distribute, publish or use our content without our prior written permission.
Content you submit
If you submit reviews, comments, photographs or other content to our site, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display that content in connection with our business.
You confirm that your content is your own, is accurate, and does not breach anyone's rights or any law. We may remove content that we consider unlawful, offensive, misleading or otherwise inappropriate.
Our liability
Nothing in these Terms limits or excludes our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- breach of your statutory rights as a consumer;
- any other liability that cannot be limited or excluded by law.
Subject to that, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.
We supply products for domestic and private use. If you use a product for any commercial or business purpose, we have no liability to you for loss of profit, loss of business, business interruption, or loss of business opportunity.
We do not guarantee that the site will always be available or free from errors, and we may suspend, withdraw or restrict it for business or operational reasons.
Events outside our control
We are not liable for delay or failure to perform our obligations caused by events outside our reasonable control, including strikes, carrier failures, extreme weather, fire, flood, epidemics, acts of government, or failures of public networks. If such an event occurs we will contact you and either extend the delivery time or, if the delay is substantial, allow you to cancel for a full refund.
Third-party links
Our site may link to third-party websites. Those links are provided for information only. We have no control over the content of those sites and accept no responsibility for them or for any loss arising from your use of them.
Changes to these Terms
We may amend these Terms from time to time. The version in force when you place an order is the version that applies to that order. Please check this page before ordering.
General
- Transfer. We may transfer our rights and obligations under these Terms to another organisation, and we will tell you if we do. You may only transfer your rights or obligations with our written consent.
- Severability. If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions continue in force.
- Waiver. If we delay in enforcing any part of these Terms, that does not prevent us from enforcing it later.
- Third parties. No one other than you and us has any right to enforce these Terms.
Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. You and we both agree that the courts of England and Wales have exclusive jurisdiction — except that if you live in Scotland you may bring proceedings in Scotland, and if you live in Northern Ireland you may bring proceedings in Northern Ireland.
